SB 1195 Summary

• Modifies delivery requirements for spirituous liquor sold by retail licensees with off-sale privileges to allow certain exceptions to labeling requirements when containers remain in manufacturer's original packaging and are kept plainly visible during transport, or when properly recorded and bagged by the licensee.

• Permits retail off-sale licensees to accept orders for spirituous liquor delivery via telephone, mail, fax, catalog, internet, or other means, with payment collected before the product leaves the licensed premises.

• Requires delivery personnel to be at least 21 years of age and to collect valid identification from customers at delivery; establishes that the sale is not complete until delivery occurs.

• Authorizes licensees to use employees or independent contractors for delivery services, with the licensee remaining responsible for all violations related to the delivery transaction.

• Directs the director to adopt rules establishing operational limits for spirituous liquor delivery by retail off-sale licensees.
