SB1207 Summary

• Amends section 37-251, Arizona Revised Statutes regarding the issuance of patents for state lands to purchasers.

• Allows the commissioner to issue a patent for less than the entire tract purchased if it is in the best interest of the applicable trust, subject to specific conditions and value requirements.

• Removes the minimum acreage requirement of one-fourth of the original tract or ten acres for partial patents (except for right-of-way cases and tracts under 40 acres).

• Requires the commissioner to ensure remaining lands have greater value than the unpaid balance and independent development potential before approving partial patents.

• Updates technical language regarding the application of provisional payment rules and clarifies that previous certificates of purchase issued before September 30, 1988 are not affected.
