Beginning January 1, 2022, restaurants and food establishments may not serve food or beverages in polystyrene foam containers for on-premises consumption.

Beginning January 1, 2023, restaurants, food establishments, hotels, motels, and resorts may not serve, package, or provide polystyrene foam containers for food or beverages.

Beginning January 1, 2024, food packagers may not package meat, eggs, bakery products, or other food in polystyrene foam containers.

The Department may grant exemptions if no acceptable alternatives exist and either undue hardship would result or the foam is needed for transportation, construction, health, or safety applications.

The Department may adopt rules to implement and enforce the prohibition, including establishing fees for exemption applications.
