Adds comprehensive definitions for "electronic smoking device," "tobacco product," and "smoking" to include e-cigarettes, vape pens, and other devices that aerosolize or vaporize substances, whether or not containing nicotine.

Expands the prohibition on smoking in public places and places of employment to include use of electronic smoking devices and oral smoking devices designed to circumvent smoking bans.

Removes the exemption for veterans and fraternal clubs from smoking prohibitions and eliminates the exemption for theatrical performances involving smoking.

Maintains existing civil penalties of $100-$500 per violation for establishments and petty offense fines of $50-$300 for individuals who smoke in prohibited areas, with fines up to $5,000 for willful or pattern violations.

Requires approval by at least three-fourths vote of each house of the legislature for the amended statute to take effect.
