SB 1507 - Administrative Review of Agency Decisions

• Modifies the scope of judicial review for final administrative decisions by allowing courts to admit new evidence and testimony at evidentiary hearings that were not presented during the original administrative proceeding.

• Establishes de novo trial standards for reviewing final administrative decisions of agencies that regulate professions or occupations under Title 32, Title 36 Chapter 4 Article 6, Title 36 Chapter 6 Article 7, or Title 36 Chapter 17.

• Grants courts authority to decide all questions of law and fact without deference to previous agency determinations in proceedings brought by or against regulated parties.

• Exempts agency actions created pursuant to Article XV of the Arizona Constitution from the judicial review procedures established in the bill.

• Clarifies that specific sections of the administrative review statute do not apply to Department of Transportation license denial, cancellation, suspension or revocation appeals.
