Department of Education shall submit an annual report by September 1 beginning in 2021 to the governor, legislature, and state board of education containing pupil discipline data by school district and charter school.

Report must include total enrollment by subgroup, disciplinary rates for each discipline measure (in-school suspension, out-of-school suspension, expulsion, law enforcement referral), and rates of disciplinary disparity by demographic subgroup.

Department of Education must track progress in reducing disciplinary rates and disparities, identify successful strategies, assess corresponding gains in student academic achievement, and survey schools implementing evidence-based strategies like positive behavior interventions and restorative justice.

Disciplinary rate is calculated as a three-year average of students with at least one discipline measure divided by total enrollment; rate of disciplinary disparity compares one subgroup's disciplinary rate to another subgroup's rate.

Subgroups include demographic categories: White, Asian, American Indian/Alaska Native, African-American, Latino, Native Hawaiian/Pacific Islander students, plus low-income students, students with disabilities, and students performing at basic or below basic level on statewide assessments.
