SB 1646 Summary

• Attorney General or designee must review county, local, and private detention facilities housing noncitizens in civil immigration proceedings by December 1, 2021, including facilities holding accompanied or unaccompanied minors on behalf of federal agencies.

• Review must examine conditions of confinement, standard of care and due process provided to detainees, and circumstances of apprehension and transfer to facilities.

• Attorney General must report findings to legislature, governor, and secretary of state by December 1, 2021, and post report on Attorney General's website and make available to public on request.

• Attorney General and designee shall have full access to detainees, officials, personnel, and records necessary to conduct the reviews.

• Section 41-200 is repealed effective June 30, 2029.
