AZ HB2005

Prohibits digital application distribution platform providers with over one million cumulative downloads from Arizona users from requiring developers domiciled in Arizona to use exclusive in-application payment systems.

Prohibits platform providers from retaliating against Arizona developers or users who use alternative payment systems or distribution platforms not affiliated with the provider.

Allows the Arizona Attorney General to investigate violations and bring civil actions for relief, and permits aggrieved persons to pursue private civil suits including recovery of attorney fees and costs.

Requires a 60-day notice period to the Attorney General before private civil actions can be filed and prohibits private suits if the Attorney General is already diligently prosecuting the same alleged violation.

Exempts special-purpose digital application distribution platforms (such as those for gaming consoles or public safety agencies) from these requirements.
