HB 2035 Summary

• Requires written parental permission before schools provide sex education instruction to students, with curricula made available for parent review online and in person at least two weeks before instruction begins.

• Prohibits sex education instruction before grade five and requires existing curricula to include instruction on laws relating to sexual conduct with minors for grades seven through twelve.

• Requires school district and charter school governing boards to review and approve sex education courses of study, provide parents meaningful opportunity to participate in review, and conduct at least two public hearings with 60-day public comment period before approval.

• Establishes parental right to review learning materials in advance and withdraw students from classes or programs containing materials objected to as harmful, including materials addressing sexuality in courses other than formal sex education.

• Requires schools to notify parents of their rights regarding sex education, classroom instruction on sexuality, immunizations, open enrollment, test results review, and other educational decisions by December 15, 2021.
