HB 2041 Summary

• Amends Arizona Revised Statutes sections 48-3701 and 48-3772 regarding multi-county water conservation districts and groundwater replenishment obligations.

• Modifies the definition of "projected one hundred year replenishment obligation" to clarify it represents the district's total projected annual groundwater replenishment obligation for each of the one hundred years following submission of the district plan of operation.

• Revises the method for calculating reserve targets for active management areas by requiring districts to add together projected replenishment obligations over a one hundred year period and subtract available water sources multiplied by the number of years available (up to one hundred years).

• Establishes that districts may transfer credits from replenishment reserve subaccounts to conservation district accounts beginning January 1, 2030 (or earlier with director approval) to satisfy groundwater replenishment obligations.

• Limits district access to excess Central Arizona Project water for replenishment reserve purposes to an amount not exceeding the access available to the Arizona Water Banking Authority.
