HB 2045 Summary

• Amends Arizona civil rights statutes (sections 41-1403, 41-1405, 41-1461, 41-1463, 41-1464, 41-1481, and 41-1492.09) to update language and definitions related to employment discrimination.

• Adds "because of sex" to include pregnancy, childbirth, and related medical conditions, requiring equal treatment of pregnant employees as other employees with similar work abilities.

• Adds new definition that "because of sex" includes pregnancy and related conditions; renumbers subsequent definitions in the Definitions section (section 41-1461).

• Changes language in section 41-1463 to require reasonable accommodations for individuals with disabilities, except those meeting the disability definition solely through being "regarded as having" a transitory or minor impairment lasting six months or less.

• Updates grammatical language throughout (changing "which" to "that," "provided that" to "if," "upon" to "on") and changes the standard for attorney general enforcement from "shall" to "may" file civil actions in certain circumstances.
