HB 2047 Summary

• Prohibits contracts between optometrists and insurers/vision plan administrators (effective January 1, 2022) from requiring optometrists to provide non-covered services at insurer-set fees or limiting optometrists' ability to offer uncovered services at independently determined prices.

• Prevents insurers from mandating optometrists use specific vendors to replenish spectacle lens inventory after dispensing covered inventory as a covered vision service.

• Allows insurers to sponsor discount programs for non-covered services if network participation is voluntary and non-participating optometrists receive equal treatment in promotions, marketing, materials, and contract terms.

• Requires all contracts to comply with these provisions by the first renewal period on or after January 1, 2022, but no later than December 31, 2022.

• Applies provisions to optometric service corporations, health care services organizations, disability insurers, group disability insurers, and blanket disability insurers, as well as third-party administrators and provider networks.
