HB2110 Summary

• Allows courts to mitigate civil penalties under traffic and vehicle code chapters if payment would cause financial hardship to the person or their immediate family.

• Permits defendants to request community restitution in lieu of paying monetary obligations (fines, civil penalties, surcharges, assessments, fees) at a rate equal to the applicable minimum wage rounded up to the nearest dollar.

• Changes community restitution credit rate from a flat $10 per hour to the minimum wage prescribed by section 23-363, subsections A and B, rounded up to the nearest dollar for juvenile offenders and adult defendants.

• Expands civil penalty mitigation considerations to include impact on restitution ability, financial hardship, receipt of government assistance, and employment or school attendance status.
