HB2502 Summary

• Amends Arizona Revised Statutes section 13-2916 to add a new offense prohibiting use of electronic communication devices to distribute a person's personal identifying information (including digital images) without consent for the purpose of inciting unwanted physical contact, injury, or harassment by a third party.

• Applies the new offense to cases where the distribution incites or produces unwanted physical contact, injury, or harassment, and extends liability to cases targeting immediate family members of the person whose information is used.

• Adds definitions for "electronic communication device," "harassment," and "personal identifying information" to clarify that personal identifying information includes home address, work address, phone number, email address, or other contact information allowing a person to be located or contacted.

• Maintains that violations of section 13-2916 are class 1 misdemeanors and may be prosecuted at either the location where communications originated or were received.

• Preserves exemptions for constitutionally protected speech and activity, and for interactive computer services, information services, and telecommunications services providing content from other persons.
