Requires children under two years of age to be in a rear-facing child restraint system unless the child weighs at least 40 pounds or is at least 40 inches tall, in which case a forward-facing system may be used.

Mandates that all child restraint systems comply with height and weight limits specified by the manufacturer.

Maintains existing civil penalty of $50 for violations, with collected funds deposited into the child restraint fund up to a $20,000 limit.

Establishes the Department of Child Safety to administer the child restraint fund and distribute systems to responsible agencies including hospitals, domestic violence shelters, homeless family shelters, and health clinics.

Allows indigent persons to borrow child restraint systems at no charge from responsible agencies for as long as needed to transport eligible children.
