HB 2614 Summary

• Allows groundwater withdrawn during CERCLA (Superfund) and metal mining remedial actions to be used for beneficial purposes without requiring a certificate of assured water supply, provided it is used within the same active management area.

• Exempts up to 65,000 acre-feet of remediated groundwater withdrawn annually across all active management areas from counting against active management area management goals through 2050, with declining percentages allowed for excess withdrawals in subsequent management periods.

• Requires the Department of Water Resources to include provisions in management plans that encourage beneficial use of remediated groundwater and to treat such groundwater consistent with surface water accounting.

• Establishes a small user exemption allowing annual remediated groundwater withdrawals of 250 acre-feet or less to avoid debiting the water provider's mined groundwater account and replenishment obligations.

• Repeals two provisions from Laws 1997 relating to prior remediated water regulations.
