HB 2650 Summary

• Establishes that an unborn child from the moment of conception is entitled to equal protection under Arizona law and extends homicide statutes (negligent homicide, manslaughter, second degree murder, and first degree murder) to include killing an unborn child at any stage of development.

• Repeals existing abortion licensing and regulation provisions in Arizona law, including abortion clinic licensure requirements and related regulations in Title 36.

• Removes duress and necessity as legal defenses for offenses involving homicide or serious physical injury, and grants concurrent jurisdiction to the Attorney General and county attorneys to prosecute violations related to homicide by abortion.

• Prohibits public funding of abortions except to save the life of the pregnant woman, and prohibits public funds or tax monies from paying for abortion-related health insurance coverage or training to perform abortions.

• Declares the act applies prospectively only, and makes the entire act void if any portion is adjudicated invalid.
