HB 2671 Summary

• Updates underground storage tank performance standards by referencing federal regulations as in effect January 1, 2020 for secondary containment, release detection, and interstitial monitoring requirements.

• Extends the baseline period for noncorrective actions and establishes a 17-year window (January 1, 2016 through January 1, 2033) during which owners and operators may elect to conduct baseline assessments and request reimbursement for costs.

• Extends reimbursement eligibility deadlines by ten years: releases must be reported by January 1, 2033 (instead of 2023), preapproval applications must be filed by December 31, 2039 (instead of 2029), and final reimbursement applications must be filed by December 31, 2040 (instead of 2030).

• Modifies the lien provision in section 49-1056 to allow the department to forgo placing a lien on property when the director orders corrective actions necessary to protect human health, safety, or the environment.

• Creates a special reimbursement pathway for owners and operators who failed to demonstrate financial responsibility but properly reported releases between July 1, 1996 and July 1, 2010, allowing up to $1,000,000 per facility in reimbursement for corrective actions conducted between July 1, 2010 and December 31, 2016.
