HB 2678 Summary

• Establishes in the Pinal Active Management Area that the director shall not review physical availability of groundwater and stored water for assured water supply designations if the total volume does not exceed what was included in the previous designation minus actual withdrawals and recoveries since issuance.

• Deems two types of stored water physically available for assured water supply purposes: existing long-term storage credits pledged to the designation, and stored water to be recovered annually or as future long-term storage credits if the water meets physical availability requirements.

• Defines "area of impact of storage" as within one mile of an existing or proposed underground storage facility, within irrigation district boundaries with a groundwater savings facility permit, or areas positively impacted by storage as demonstrated by an approved hydrologic model.

• Amends the certificate of assured water supply assignment process to clarify that changes in the number of housing units or lots do not constitute a material change to a subdivision plat, plan, or map.

• Grants the director authority to extend the rules adopted under this act to other active management areas beyond Pinal.
