SB 1007 Summary

• Amends Arizona Revised Statutes section 8-533 to add a new ground for termination of parent-child relationship based on sexual assault that resulted in conception.

• Allows termination when clear and convincing evidence shows a parent committed sexual assault (sexual intercourse or oral sexual contact without consent) against the other parent and the child was conceived as a result.

• Permits courts to accept a guilty plea or conviction under Arizona's sexual assault statute (section 13-1406) or equivalent offense in another jurisdiction as evidence that the child was conceived from sexual assault.

• Defines key terms including "sexual intercourse," "oral sexual contact," and "sexual assault" by reference to Arizona's existing sexual conduct statutes.

• Became effective July 9, 2021.
