Referral agencies must disclose to prospective residents or their representatives any business relationships, common ownership, or financial connections with assisted living facilities or homes before making a referral.

Referral agencies must disclose the amount of fees (or good faith estimates) that assisted living facilities will pay them, described as either a dollar amount or percentage of the resident's first month's rent and care charges.

Prospective residents may terminate referral agency services at any time by written or electronic notice, and the agency loses entitlement to fees unless the facility was specifically referred before termination or the resident communicated with the agency before admission.

Referral agencies must provide disclosures in a prescribed 14-point font format that includes specific language about business relationships, fee ranges, and termination rights; residents must acknowledge receipt of the disclosure.

Assisted living facilities cannot pay referral fees until receiving written or electronic copies of the disclosure and resident acknowledgement; facilities must maintain copies while residents are present and referral agencies must maintain copies for one year, with violations subject to civil penalties up to $1,000 per violation.
