SB 1037 - Water Efficient Plumbing Fixtures

• Replaces specific water flow/usage standards with requirement that plumbing fixtures be WaterSense-labeled or meet WaterSense program efficiency criteria established before January 1, 2021, effective January 1, 2021 for residential construction and January 1, 2022 for commercial/industrial/public construction.

• Redefines "nonwater consuming urinal" to reference ASME A112.19.19 standard (as in effect January 1, 2021) instead of older ASME and ANSI standards, and adds new definitions for "WaterSense-labeled plumbing fixture" and "WaterSense program."

• Requires state buildings to install nonwater consuming urinals in new capital projects and directs the Department of Administration to install such urinals in existing state buildings when feasible.

• Extends the effective date for plumbing fixture requirements from January 1, 1994 to January 1, 2021 (residential) and 2022 (commercial/industrial/public), and updates the inventory exemption date to January 1, 2022.

• Allows county, city, or town ordinances on water-conserving plumbing fixtures that are at least as restrictive as state requirements or regulate unspecified fixtures.
