Establishes civil liability for health care providers who use donor gametes (eggs or sperm) in assisted reproduction procedures without the patient's express consent.

Permits patients, their spouses or partners, surviving spouses or partners, and children born from the procedure to bring civil actions seeking either actual damages (including emotional distress) or liquidated damages of $50,000 plus attorney fees.

Allows separate causes of action for each child born as a result of the unauthorized assisted reproduction procedure.

Creates a new class 6 felony offense called "misuse of gametes" for health care providers who knowingly use donor gametes without patient's express consent.

Defines key terms including "assisted reproduction" (in vitro fertilization, insemination, embryo donation and transfer, and intracytoplasmic sperm injection), "donor," "gametes," and "health care provider."
