SB1063 Summary

• Amends section 12-910 to establish that courts reviewing administrative decisions of agencies regulating professions or occupations under title 32, title 36 chapter 4 article 6, title 36 chapter 6 article 7, and title 36 chapter 17 shall conduct de novo trials if demanded in the notice of appeal or motion.

• Modifies section 12-910 to clarify that in proceedings brought by or against a regulated party, courts shall decide all questions of fact without deference to any previous agency determination.

• Amends section 28-3317 to exclude subsections D and E of section 12-910 from applying to judicial review of license denial, cancellation, suspension or revocation decisions by the department.

• Requires courts to expedite the disposition of appeals related to license decisions under section 28-3317.
