Beginning January 1, 2023, restaurants and food establishments cannot serve food or beverages in polystyrene foam containers for on-premises consumption.

Beginning January 1, 2024, restaurants, food establishments, hotels, motels, and resorts cannot serve, package, or provide polystyrene foam containers for prepared food or beverages.

Beginning January 1, 2025, food packagers cannot package meat, eggs, bakery products, or other food in polystyrene foam containers.

The Department of Environmental Quality may grant exemptions if no acceptable alternatives exist and either undue hardship would result or the foam is used for transportation, construction, health, or safety applications.

The Department may adopt rules to implement and enforce the prohibition, including establishing an exemption application fee.
