SB 1218 Summary

• Transfers Title 32, Chapter 44 (occupational regulation standards) to Title 41, Chapter 33 and adds definition section for occupational regulations, government certification, government registration, and less restrictive regulations.

• Amends Section 41-2954 to require committees of reference reviewing agencies administering occupational regulations to evaluate whether the regulation meets statutory criteria and consider recommending repeal, conversion to less restrictive regulation, or legislative changes to the scope of practice and personal qualifications.

• Establishes that professions and occupations shall only be regulated to protect public interest, not to protect from economic competition, and only if credible evidence shows unregulated practice threatens public health, safety or welfare and regulation's benefits clearly exceed costs.

• Requires regulation of professions or occupations to be in the least restrictive manner available, including options such as private certification, mandatory disclosure, inspection requirements, bonding, insurance, government registration, or government certification before imposing occupational or professional licenses.

• Requires legislative committees of reference to evaluate criteria for new occupational regulation and provide findings to standing committees, which must address appropriate regulation types, scope of practice, personal qualifications, and impacts on insurance, interstate practice, federal licensure, and constitutional practices.
