SB 1231 Summary

• Repeals Title 11, Chapter 7, Article 8 of Arizona Revised Statutes and repeals sections 13-1509, 13-2928, 13-2929, and 41-1724 related to immigration enforcement.

• Removes authorization for peace officers to arrest persons based on removability from the United States and eliminates provisions allowing vehicle stops for transporting or harboring undocumented aliens.

• Eliminates the gang and immigration intelligence team enforcement mission border security subaccount, redirecting the associated $4 penalty assessment to the public safety equipment fund instead.

• Removes entrapment affirmative defense provisions from employer employment of unauthorized aliens statutes (sections 23-212 and 23-212.01).

• Modifies e-verify requirements by removing the December 31, 2007 deadline and changing employment verification record retention to the duration of employment or three years, whichever is longer.
