SB 1258 Summary

• Tolls the remaining period to exercise rights under permits, licenses, approvals, or other authorizations for land development, construction, and real property improvements issued by the Department of Environmental Quality or local governments during a gubernatorial state of emergency proclamation.

• Tolling runs from when the issuing authority determines ordinary government operations were altered or limited until operations return to normal, with an additional six-month extension after the tolling period ends.

• Requires issuing authorities to post conspicuous website notices including the dates operations were altered/limited and resumed, the new expiration date, and the process for permit holders to provide written notice of intent to extend if required.

• Exempts permits located outside the emergency area, those regulated by federal law, permits held by applicants with significant noncompliance violations, permits subject to conflicting court orders, transaction privilege tax licenses, and business licenses.

• Prohibits penalties or fines for activities allowed under extended permits during the tolled and extended period, and maintains applicability of laws in effect on the emergency effective date unless they create immediate public health or safety threats.
