SB1274 Summary

• Adds section 45-576.08 establishing that in the Pinal Active Management Area, the director shall not review physical availability of groundwater and stored water for applications to modify assured water supply designations if the total volume does not exceed the previous designation minus actual withdrawals since issuance.

• Deems stored water physically available for assured water supply purposes if it consists of existing long-term storage credits or water to be stored on an annual basis or as future long-term storage credits meeting physical availability requirements.

• Defines "area of impact of storage" to include locations within one mile of storage facilities, within irrigation district boundaries with groundwater savings facilities, or areas hydrologically demonstrated to be positively impacted by water storage.

• Amends section 45-579 to clarify that a reduction in total water demand does not constitute a material change to a subdivision plat, allowing certificate assignments and plat modifications without triggering additional review requirements.

• Grants the director authority to extend the Pinal Active Management Area rules regarding assured water supply to other active management areas through rule revision.
