AZ SB1328

Declares any federal act, law, treaty, order, rule or regulation that violates Arizona Constitution Article II, Section 26 or U.S. Amendment II is null, void and unenforceable in Arizona.

Prohibits Arizona state and political subdivisions from using personnel or financial resources to enforce, administer or cooperate with federal firearm laws that violate the state or federal constitutions.

Creates civil liability allowing any citizen to sue state or local government entities, agencies, employees or officials for declarative relief, injunctive relief, damages and attorney fees for enforcing prohibited federal firearms laws; eliminates sovereign and qualified immunity for such actions.

Makes enforcement of prohibited federal firearms laws a Class 1 misdemeanor for first offense and Class 6 felony for subsequent offenses, with mandatory maximum fines and sentences.

Exempts special taxing districts operating federal reclamation projects from the law's provisions.
