SB 1340 Summary

• Requires all school districts and charter schools to provide medically accurate and age-appropriate sex education instruction in kindergarten through grade 12, with instruction on sexual conduct laws required for grades 7-12.

• Sex education instruction must cover physical and emotional development, critical thinking skills, consent and personal boundaries, vulnerable populations including LGBTQ and disabled students, healthy relationships, and contraception methods for grades 6-12.

• Prohibits sex education instruction that discriminates based on sex, race, ethnicity, national origin, disability, religion, sexual orientation, gender expression, or gender identity, and ensures students with disabilities receive appropriate accommodations.

• Requires parents to provide written permission for their child to not participate in sex education instruction, with materials made available for parental review and no disciplinary penalties for opted-out students.

• Establishes that the state board of education shall designate minimum qualifications for sex education instructors and may adopt rules to enforce the requirements and procedures for complaints and appeals.
