SB 1366 Summary

• Extends the deadline for groundwater withdrawal exemptions from 2025 to 2050 for remedial action projects under CERCLA or Arizona Title 49.

• Maintains the 65,000 acre-feet annual aggregate limit for remediated groundwater use across all active management areas that counts toward management goals.

• Allows withdrawals exceeding 65,000 acre-feet to be partially counted toward management goals based on management period, with percentages declining from 75% in the second period to zero percent after 2050.

• Exempts annual remediated groundwater withdrawals of 250 acre-feet or less from being debited against a water provider's mined groundwater account and removes replenishment obligations for these small-volume users.

• Requires municipal water providers to apply for director approval of groundwater use consistency determinations before January 1, 2010.
