Senate Bill 1373 Summary

• Health care institutions must have an affirmative duty of care for residents and ensure CPR-certified staff are available at all times to initiate cardiopulmonary resuscitation before emergency services arrival, in accordance with advance directives.

• Health care institutions must provide first aid certified staff available at all times to assist residents in distress or those who have fallen and appear uninjured but cannot recover independently, consistent with advance directives.

• Health care institutions cannot establish or implement policies that prevent employees from providing appropriate cardiopulmonary resuscitation and first aid.

• Health care institutions and employees rendering CPR or first aid in good faith consistent with certification standards are immune from civil liability, except in cases of gross negligence.

• Each health care institution must develop and administer a training program for all staff on fall prevention and fall recovery, including initial and continued competency training.

• Applies to assisted living centers, assisted living facilities, assisted living homes, hospice, nursing care institutions, and residential care institutions licensed under Arizona law.
