SB1388 Summary

• Allows behavioral health residential facilities and outpatient clinics to provide respite care to children for short periods without requiring a medical history and physical examination.

• Respite care is limited to fewer than five consecutive days and not more than 12 days per 90-day period for residential facilities, or up to 10 continuous hours per day (6:00 a.m. to 10:00 p.m.) for outpatient clinics.

• Exempts providers offering only respite services from six licensure requirements including counseling services, discharge orders, medication regime review, tuberculosis screening, and advance food menu posting.

• Requires respite care providers to receive medication and allergy information and emergency contact information upon the child's arrival.

• Requires documentation of any illness, injury, emergency safety response, or unacceptable behavior during respite stay to be provided to parent, guardian, or custodian.
