SB 1794 Summary: Historic Race Wagering

• Authorizes historic race wagering (wagering on previously run races with official results) at commercial horse racing tracks and additional wagering facilities operated by commercial live-racing permittees.

• Allows up to 7,500 historic racing terminals statewide or 15% of tribal-state gaming compact positions (whichever is greater), initially allocated evenly among racetracks that conducted live racing as of January 1, 2019 and held at least 21 racing days in 2019.

• Requires permittees to enter written agreements within six months with recognized horsemen's organizations and horse breeder nonprofits to share a percentage of historic race wagering revenue for purses and breeding programs.

• Prohibits municipalities, counties, and other government entities from imposing taxes, fees, or assessments on historic race wagering or the gross revenues generated.

• Limits property owners or lessors of additional wagering facilities to charging no more than 1.5% of gross revenues from historic race wagering as rent or fees.
