SCR 1031 - Commission on Appellate Court Appointments

• Proposes amending Arizona Constitution Article VI, Section 36 to restructure the commission on appellate court appointments from 16 members (1 chief justice, 5 attorneys, 10 non-attorneys) to 17 members by adding 2 more attorney members.

• Changes appointment authority for non-attorney members from solely the governor to a rotating system among the governor, speaker of the house, house minority leader, senate president, and senate minority leader.

• Changes appointment authority for attorney members from the governor (with state bar nomination) to alternating appointments between the governor and the chief justice (with state bar nomination).

• Requires if a vacancy occurs mid-term, the entity that made the original appointment must fill the replacement, regardless of whose turn it is in the rotation.

• Submits the proposed amendment to Arizona voters at the next general election for approval.
