HB2010 Summary

• Expands flags that homeowners associations and planned communities cannot prohibit displaying to include first responder flags (law enforcement, fire department, paramedics/EMTs), blue star service flags, and gold star service flags, in addition to existing protections for American, POW/MIA, Arizona state, Arizona Indian nations, and Gadsden flags.

• Defines "first responder flag" with specific color and design limitations for each service type: law enforcement (blue, black, white with generic police shield), fire department (red, gold, black, white with generic Maltese cross), and paramedics/EMTs (blue, black, white with generic star of life).

• Allows first responder flags to incorporate designs from one or two other first responder flags to form a combined flag.

• Permits associations to adopt reasonable rules regarding flag placement and manner of display but prohibits banning flagpoles; planned community associations may limit members to displaying no more than two flags at once and restrict flagpole height to rooftop height.

• Applies same restrictions on flag display to both condominium associations under section 33-1261 and planned community associations under section 33-1808.
