HB 2172 Summary

• Permits real estate licensees to receive compensation from employers other than their licensed broker if the employer holds a license, employs the licensee on a W-2 basis, shares the same employing broker, and obtains written permission from the employing broker.

• Maintains existing requirement that licensees through professional corporations or professional limited liability companies receive compensation only through those licensed entities of which they are an officer, shareholder, member, or manager.

• Makes clarifying grammatical and technical amendments to Arizona Revised Statutes sections 32-2101 (definitions), 32-2153 (grounds for discipline), and 32-2155 (compensation restrictions).

• Updates language regarding unlicensed compensation recipients and ensures mortgage broker services remain subject to separate licensing requirements under title 6, chapter 9.
