Prohibits health care institutions from imposing any treatment, including vaccination, on patients who decline and from withholding services due to refusal.

Permits parents or authorized representatives to accept treatment on behalf of minors or incapacitated patients, and allows patients to leave health care institutions at any time.

Establishes damages of $20,000 per violation per patient (adjusted for inflation) plus attorney fees for violations, with a right to jury trial and expedited 24-hour superior court hearings for discharge disputes.

Declares that the right to refuse treatment, including vaccination, is a fundamental public policy of the state.
