HB 2721 Summary

• Requires at least two-thirds of members, staff, employees or seats on any government committee, board, agency, department, office or entity that investigates, influences, certifies, recommends discipline for, or imposes discipline on law enforcement officers must be AZPOST-certified law enforcement officers from the same department or agency as the officer under investigation.

• Requires a majority vote for any findings or recommendations regarding investigation, certification, recommendation of discipline, or imposition of discipline for law enforcement officer misconduct.

• Allows supervisors, departments, or agency heads to independently investigate and impose discipline if the government entity does not meet the two-thirds requirement.

• Exempts review-only entities without authority to determine initial discipline levels, the Arizona Peace Officer Standards and Training Board, multijurisdictional task forces with at least two-thirds AZPOST-certified officers, and federal employment discrimination investigations.

• Applies retroactively to December 31, 2020, and was approved and filed by the Governor on July 6, 2022.
