HB 2751 Summary

• Amends Arizona law to create a supported decision-making agreement process allowing adults with disabilities to voluntarily designate a supporter to assist with life decisions without surrendering decision-making authority.

• Supporters may help adults understand options, access information, and communicate decisions regarding housing, health care, employment, education, finances, and services, but cannot make decisions on behalf of the adult or sign legal documents.

• Requires supporters to act in good faith, with loyalty, without self-interest, avoid conflicts of interest, and prohibits supporters from receiving compensation for their role.

• Agreements must be signed by the adult and supporter before two witnesses or a notary public and automatically terminate if the adult becomes incapacitated or if a guardian is appointed unless the guardian consents to continuation.

• Prohibits intimidation or deception in procuring agreements, subjects violators to criminal prosecution and civil penalties, and allows interested persons to petition the court to determine agreement validity; effective December 31, 2022.
