HB 2861 Summary

• Establishes the Water Infrastructure and Commerce Grant Fund administered by the chief executive officer, with monies used to provide grants to eligible employers with over 250 employees and public service corporations for water infrastructure projects in counties with populations between 400,000 and 1 million persons.

• Requires the Department of Environmental Quality to establish by December 31, 2024, permit fees and rules for a direct potable reuse of treated wastewater program, with collected fees deposited into the Water Quality Fee Fund.

• Allows the Department of Environmental Quality to use up to $6,531,000 from the Underground Storage Tank Revolving Fund in fiscal year 2022-2023 for administrative costs and remediation of sewage discharge issues in Naco and other border areas.

• Caps vehicle emissions testing fees in fiscal year 2022-2023 at no more than fiscal year 2021-2022 levels and exempts the department from rulemaking requirements until July 1, 2023.

• Permits the Arizona Department of Agriculture to continue, increase, or lower existing fees in fiscal year 2022-2023 with projected revenue increases not exceeding $357,000 across three designated funds.
