AZ HCR2013

Requires all firearm sales or transfers to be conducted through a licensed firearms dealer, with limited exceptions for law enforcement, military, gunsmiths, and other specified parties.

Licensed dealers must conduct background checks on purchasers under federal law (18 U.S.C. § 922(t)) and may charge a fee of up to $20 to cover administrative costs for facilitating private transfers.

If a purchaser fails the background check, the dealer must conduct a background check on the original seller; if the seller also cannot legally receive the firearm, the dealer must deliver it to law enforcement within 24 hours.

Exempts bona fide gifts between immediate family members (spouses, parents, children, siblings, grandparents, grandchildren, nieces, nephews, first cousins, aunts, uncles), loans for lawful hunting or sporting purposes, antique firearms, and transfers to prevent imminent death or bodily harm.

Violation of this section is classified as a class 5 felony and requires submission of the measure to voters at the next general election.
