SB 1010 Summary

• Prohibits school districts from ejecting persons or groups engaged in peaceful protesting from school property or meeting locations after school hours, or taking adverse action against them.

• Peaceful protesting on school property after school hours does not violate Arizona's disorderly conduct statute (section 13-2911).

• Eliminates permit and authorization requirements for peaceful protesting on school property or near school district governing board meetings after school hours.

• Defines "peaceful protesting" as protesting that does not pose a threat to persons, damage property, or interfere with or disrupt activities at school locations or meetings.

• Requires all school district governing board elections statewide to use partisan primary elections followed by general elections, with candidates' partisan designations displayed on ballots, effective January 1, 2023.
