SB 1067 Summary

• Amends Arizona law to allow cities, towns, counties, and sanitary districts to obtain financial assistance from the water infrastructure finance authority for water and wastewater infrastructure projects without voter approval during fiscal years 2022-2027 if funded through the federal Infrastructure Investment and Jobs Act.

• Prohibits the water infrastructure finance authority from providing funds to cities or towns to condemn or acquire assets of regulated public service corporations through eminent domain unless the corporation provides written certification as a willing seller.

• Clarifies that financial assistance loan repayment agreements do not create municipal debt and may be repaid from utility revenues or other authorized revenue sources without requiring voter approval in certain circumstances.

• Extends eligibility for the exemption from voter approval election requirements to all population sizes of cities and towns, all counties, sanitary districts with populations under 50,000, and domestic water or wastewater improvement districts.
