SB1157 Summary

• Requires plaintiffs in asbestos personal injury claims to file a sworn statement within 45 days of filing an action, in addition to existing requirements under section 12-782.

• Sworn statement must specify with particularity: exposed person's name, address, date of birth, employment history, smoking history, all asbestos-containing products involved, manufacturers/sellers, specific exposure locations and manner, exposure dates and frequency, asbestos-related disease claimed, and knowledgeable witnesses.

• Includes requirement to disclose exposures through third parties if the exposed person was exposed via another person.

• Court shall dismiss claims without prejudice against any defendant whose product or premises is not identified in required disclosures, or against all defendants if plaintiff fails to comply with statement requirements.

• Plaintiff has continuing duty to supplement required disclosures and applies to asbestos claims filed on or after the effective date.
