SB 1226 Summary

• Repeals Title 11, Chapter 7, Article 8 of Arizona Revised Statutes and sections 13-1509, 13-2928, 13-2929, and 41-1724 relating to immigration enforcement and gang/immigration intelligence team funding.

• Removes language from section 13-2319 (human smuggling) that authorized peace officers to stop persons based on reasonable suspicion of civil traffic law violations in furtherance of smuggling enforcement.

• Removes language from section 13-3883 (arrest without warrant) that allowed arrests when a person committed any public offense making them removable from the United States.

• Eliminates the entrapment defense provisions in sections 23-212 and 23-212.01 (employment of unauthorized aliens), and modifies funding allocations by removing references to the gang and immigration intelligence team enforcement mission border security subaccount.

• Removes provisions from section 28-3511 that authorized vehicle removal and impoundment for transporting or harboring aliens in violation of federal immigration law.
