Employers who mandate or coerce employees to receive a medical product or procedure are liable for all injuries and damages caused by the medical product or procedure, including disability, physical or emotional injury, lost wages, pain and suffering, and medical expenses.

Employers are liable to an employee's dependents for the employee's death if the death resulted from a mandated or coerced medical product or procedure.

If injury arises within 120 days after receiving the medical product or procedure, it is presumed the medical product or procedure caused the injury.

Prevailing employees are entitled to attorney fees and a statutory damage award equal to three times the actual damages.

Employees may file civil actions under this section without being required to exhaust workers' compensation claims, and any workers' compensation award received must be reduced from the civil damages awarded.
