SB 1437 Summary

• Requires the Attorney General to develop a model policy within 12 months limiting immigration enforcement at public schools, health facilities, courthouses, and shelters to ensure access regardless of immigration status; public schools, health facilities, and courthouses must adopt consistent policies or notify the Attorney General with reasons for non-compliance.

• Prohibits state agencies from using funds or resources to investigate, enforce, or assist in federal immigration surveillance programs targeting residents based on race, religion, immigration status, or national origin; requires agencies to limit collection and disclosure of immigration-related information to legally required circumstances.

• Bars state and local law enforcement from inquiring about immigration status unless connected to criminal investigations, honoring civil immigration warrants or hold requests for detention purposes, or providing information to federal immigration authorities except as required by law.

• Prohibits state and local law enforcement from entering into immigration detention agreements; existing agreements must terminate by June 30, 2023 (or December 31, 2025 for pre-January 1, 2023 agreements).

• Establishes a Keep Arizona Working statewide work group of 11 members to develop strategies supporting immigrant workforce participation, career pathways, and business opportunities; requires annual reporting to the Governor and Legislature.
