Prohibits sellers from increasing prices more than 10% above pre-emergency levels for building materials, food, emergency supplies, gasoline, medical supplies, repair services, and transportation/storage services during state or local emergencies and for 30 days after.

Allows exceptions to the 10% cap if sellers can prove price increases are directly attributable to additional supplier costs, labor costs, or material costs, provided the total does not exceed cost-plus customary markup.

Restricts hotel and motel operators from raising room rates more than 10% above pre-emergency advertised rates, with exceptions for documented additional costs, seasonal adjustments, or previously contracted rates.

Establishes civil penalties up to $10,000 per violation enforceable by the Attorney General under existing unlawful trade practices laws.

Grants private right of action for consumers who suffer losses due to price gouging, allowing courts to award treble damages plus reasonable attorney fees and court costs.
